You may have seen a warning on some ProSupps products have left you concerned about what you may be ingesting. We get it and want to provide you with some background to help put your mind at ease. This is a “Prop 65 warning”, which is required by the state of California and can be found on most products from children’s toys to produce and coffee. Prop 65 is a law that seeks to protect consumers—using warning statements—from chemicals that (according to California) may cause cancer or be harmful to reproductive health. Prop 65 sets incredibly strict rules regarding the potential presence of certain chemicals in consumer products.
Since becoming law in 1986 the list has ballooned to around 900 different chemicals. Many of these have yet to show harm to humans…in many cases, simply showing harm in animal testing is enough to get it on the list. The law then requires any company doing business in California to tell consumers that a Prop 65 chemical is in a product by adding a warning like the one we talked about earlier.
This puts top companies in a tough spot because this well-intentioned law is to protect folks from things like synthetic/man-made compounds that show up in things like pesticides, insecticides, and agrichemicals. However, many of substances on the Prop 65 list—such as lead and cadmium—are found in even the cleanest, safest soils in the world. The amounts are hundreds of times lower than the levels set by the Food & Drug Administration (FDA), Environmental Protection Agency (EPA) and World Health Organization (WHO).
Using lead as an example, a product must include a lead warning if it has 0.5mcg of lead. By contrast, the FDA calculated a “provisional” total tolerable intake of 75mcg of lead/day. That means that up to 75mcg can safely be consumed by adults every day! That’s 150 times greater than the amount that triggers a Prop 65 warning in California
Based on these extremely rigid guidelines, food and supplement companies—ProSupps included—require these warnings on product labeling, even though our products are extremely safe and healthier than most of the packaged foods in grocery stores that likely won’t have the same warning.
So why don’t similar products have the same warning? Until August of 2018, enforcement of the Prop 65 warnings was relatively inconsistent. Inconsistent enforcement explains why some products have the warnings and nearly identical products do not. It’s important to remember that a lack of warnings does not necessarily mean that the products is free of the same substances at similar levels. Some companies simply take the risk and are probably just counting down the days till they face a lawsuit because they don’t include a Prop 65 warning.
